Some Sheriffs Vow Not to Enforce Obama Gun Plan
Denny Peyman, sheriff of Jackson County, Ky., is one of several sheriffs across the country who are vowing not to enforce new firearms restrictions that could be imposed by Congress or by executive order.
“Kentucky is a sovereign state,” Peyman said. “The federal government is coming in and saying, ‘This is what you’re going to do.’ We’re not going to do it.”
The White House’s wish list includes an assault-weapons ban. Peyman said if it comes to pass, he won’t be part of any crackdown.
“Let’s say I know there’s a thousand assault weapons in my county … I’m not going to be a witch hunter and go door to door checking,” he said.
“I just happen to see someone with one?” he added. “He’s hunting? He’s on his own property? I’m not going to do a thing to him.”
Sheriff Peyman told residents in a town hall meeting that the sheriff has more power than the federal government, and that he will disobey any directive from the administration. (Wed. 1/16/2013)

Minnesota Sheriff: Federal Government Has No Right to Dictate Gun Control
Pine County, Minnesota Sheriff Robin Cole sent a letter to Vice President Joe Biden saying federally-mandated gun control measures violate his interpretation of the Constitution and won’t be enforced in his county if passed.

As Sheriff of Pine County, it is important for residents to know my position as it relates to the Second Amendment to the Constitution of the United States. In the past week I have had several requests and one meeting on this matter. Normally I attempt to remain neutral on matters of politics but this issue transcends political division and I feel it appropriate to state my position.
I believe that the right to keep and bear firearms is fundamental to our individual freedom and that firearms are a part of life in our county. The Federal Government has a constitutional role in the governance of our republic but the United States of America is a democratic republic of individual sovereign states. Each state has the absolute right to establish laws, within the confines of the constitution which is the supreme law of this republic, to regulate behavior.
As Sheriff, I swore an oath to follow the Constitution of the United States and to enforce the laws of the State of Minnesota. I believe current state law is sufficient to protect the public safety while providing individuals the right to keep and bear arms.
If the State of Minnesota desires to change current law, then it must do so through the legitimate process of legislation. In my opinion it is a moral sin to erode freedom through obscure regulation and administrative rules. I believe this is also true for both State and Federal Government.
I do not believe the Federal Government or any individual in the Federal Government has the right to dictate to the states, counties or municipalities any mandate, regulation or administrative rule that violates the United States Constitution or it various amendments. I would view any such mandate, regulation or administrative rule illegal and refuse to carry it out.

Linn County Sheriff Says Obama Gun Laws Will Not be Enforced
Linn County Oregon Sheriff Tim Mueller says he will not enforce any federal regulation that President Barack Obama laid out in his package of gun control proposals Wednesday.
Mueller sent a letter to Vice President Joe Biden this week saying he won’t enforce any federal regulation “offending the constitutional rights of my citizens.” He won’t permit federal officers to come to his county to enforce such laws either, he said.
Mueller’s defiant stand exploded into a groundswell of support. His letter — posted on the department’s Facebook page — earned more than 59,000 likes and shares — and was growing by the minute.
Mueller says he took an oath to support the Constitution, and laws preventing citizens from owning certain semi-automatic firearms and ammunition magazines would violate their rights.
Though the letter might add fuel to an already hot topic, Mueller told The Associated Press he wishes people could have a civilized discussion about the issue, rather than resort to threats and name-calling.

I am Sheriff Tim Mueller, elected twice by the citizens of Linn County Oregon who have entrusted me with a noble cause: to keep them and their families safe. My deputies and I take that responsibility very seriously and, like you, have sworn to support the Constitution of the United States. I take that oath equally as serious as protecting our citizens. I have worked for the people of Linn County for over 28 years as a member of the Linn County Sheriff’s Office as well as serving three years active duty as a Military Police Officer in the US Army, where I also swore a similar oath.
In the wake of the recent criminal events, politicians are attempting to exploit the deaths of innocent victims by advocating for laws that would prevent honest, law abiding Americans from possessing certain firearms and ammunition magazines. We are Americans. Crook County Sheriff Opposes New Gun Laws
Crook County Sheriff Jim Hensley explained his decision Wednesday to write a letter to Vice President Joe Biden, saying he and his deputies won’t enforce any new gun laws or regulations passed by President Obama or Congress that he believes are unconstitutional.
“I’m going to follow my oath that I took as Sheriff to support the constitution,” Hensley said.
Hensley took the offer from his Linn County counterpart and fired off a blistering letter Tuesday to Vice President Joe Biden.
Linn County Sheriff Tim Mueller sent the vice president such a letter Monday, accusing politicians of “attempting to exploit the deaths of innocent victims by advocating for laws that would prevent honest, law abiding Americans from possessing certain firearms and ammunition magazines.”
“Banning firearms and magazines, that is not going to cure the problem,” Hensley said.
In his letter, Mueller wrote, “We are Americans! We must not allow, nor shall we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the liberties of responsible citizens who have broken no laws.”
Mueller also circulated the letter to other Oregon sheriffs and suggested they could send a similar letter, if they agreed with him, according to Hensley, who did so on Tuesday, saying he “felt the same way” as the Linn County law enforcer.
“I said, you know what? It’s a clear statement. He hit the nail right on the head,” Hensley said Tuesday night.
Hensley’s letter, changed only by county name, stated: “Any federal regulation enacted by Congress or by executive order of the President offending the constitutional rights of my citizens shall not be enforced by me or by my deputies, nor will I permit the enforcement of any unconstitutional regulations or orders by federal officers within the borders of Crook County, Oregon.”
“In summary, it is the position of this Sheriff that I refuse to participate, or stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians,” Hensley concluded.
Asked why he sent the letter, Hensley said Tuesday night, “I believe strongly in the Second Amendment.”
“If the federal government comes into Crook County and wants to take firearms and things away from (citizens), I’m going to tell them it’s not going that way,” the sheriff said.
But Hensley also says that despite all the talk, he doesn’t believe things will go that far, “because there’s so much opposition in this country” to more restrictions on gun ownership.
“Some people go so far as to ask, ‘Well, are you going to fight our military when they come to take our guns?’” Hensley said. “I say absolutely not – we’re not going to get into a gun battle with our fellow citizens. But I will do everything in my power to defend their right to the Second Amendment.”
Henley said in his view, “They are addressing the wrong topics,” and he points to violent video games as an example: “Kids for years now play video games in which they have committed thousands of homicides. I believe those games are teaching kids games they shouldn’t be doing, instilling a mindset to kill as many people as in a video game.”
“I’m not saying outlaw the games,” the sheriff said, but “if you’re going to look at firearms,” you should look at other factors that may also play a role in such mass shootings.
Hensley noted that there are already “hundreds of gun laws on the books. A responsible gun owner – a responsible person knows who they are selling a firearm to, or trading with. The bottom line is, I don’t even believe that people, in my opinion, should have to have a concealed weapons permit. There’s other states that don’t.” (Wed. 1/16/2013)
