Last month in the sleepy little village of Cloudcroft, located in Otero County, New Mexico, hundreds of people rallied at what is being called the “Otero County Tree Party”, in support of the rights guaranteed the states and the people through the Constitution’s 10th Amendment.

A decade ago, after the 2000 Los Alamos wildfire caused severe economic and social repercussions to the state of New Mexico, the state legislature, citing “continuing federal inaction to reduce the fuel buildup of wilderness areas, thus placing the lives and property of the citizens of New Mexico at risk from uncontrollable but preventable wildfires”, overwhelmingly approved a bill known simply as SB-1, which exerted local sovereignty over public lands. It was subsequently signed into law by former governor Gary Johnson.

For the next ten years the law sat on the shelf untested, until the Wallow and Las Conchas wildfires wreaked havoc throughout the state in 2011. At that point the folks in Otero County, which includes part of the Lincoln National Forest, began to feel like the next catastophe waiting to happen. They’d been patiently negotiating with the United States Forest Service over the entire decade since the devastating Los Alamos fire, in an ongoing attempt to get the feds to properly manage the overgrown, neglected, tinderboxlike wilderness area — but to no avail. Eventually it became apparent the feds were going to offer up nothing more than bureaucratic lip service.

Fed up and feeling under the gun to make something happen before it was too late, the county declared a state of emergency and the Board of Otero County Commissioners, with Ronnie Rardin as chairman, drafted the Emergency Forest Management Plan. On September 9, 2011, a public hearing was held and approval was acquired to put the plan into effect.

Banking on the 1976 Federal Land Policy and Management Act’s requirement that public land be managed in coordination with state and local governments, and that New Mexico state law provides for local sovereignty over such land, Governor Susana Martinez gave the green light for Congressman Steve Pearce and the Otero County Commissioners to put the feds on notice of the county’s intention to enter the national forest with professional logging crews and begin clean-up operations. The federal government fired back that if they did so, it would arrest Congressman Pearce, the Commissioners, and anyone else directly involved.

That’s when Sheriff House entered the fray. By law the ultimate law enforcement authority within his jurisdiction, he told the feds in no uncertain terms that if they entered Otero County for the express purposes of detaining any state or local authorities, he’d personally arrest them on kidnapping charges and jail them!

Not only that, but when the Otero Tree Party rally kicked off on Saturday, September 17, and tree-cutting operations began, Sheriff House and his men, in full SWAT team regalia, rolled up in an armored personnel carrier, ready to do battle with any feds that crossed the line!

None did.

The bullies backed down, knowing they had no constitutional or statutory authority to make good on their idle threats to begin with when their bluff was called. They didn’t even show up.

The trees were cut, the town was saved, and all the participants of the Tree Party emerged as heroes. And more importantly, Sheriff Benny House set a sterling example every American citizen should be aware of and take pride in: that if you show enough backbone, you know you’ve got the law and the Constitution on your side, and you’re ready to go mano a mano, you can back these soulless cutthroat bastards down and emerge victorious.
