In her documentary The End of America, Naomi Wolf outlines the 10 steps through which all nations establish a dictatorship.

Those steps are:

1. Create an internal/external threat that terrorizes the populace. This has already been accomplished with Oklahoma City (false flag) and 9/11 (another false flag).

2. Create secret prisons, with torture. Obama did this nicely with the NDAA (as well as keeping GITMO open even after promising he would close it).

3. Create a paramilitary force. This is the TSA.

4. Single out ordinary citizens as ‘troublesome persons.’ This has been accomplished by Janet Napolitano’s “if you see something, say something” propaganda campaign.

5. Establish surveillance of citizens’ groups and ordinary citizens deemed ‘troublesome.’ This is already well under way through surveillance of emails, phone calls, vehicle movements and more.

6. Detain and release citizens without formally charging them with any crime. This has been “legalized” under Obama’s NDAA.

7. Target key individuals who are well known, popular figures. This has already begun and will likely accelerate. Who do you think killed Andrew Breitbart? Congressman Bono?

8. Restrict the press. Already done. The U.S. government, in fact, essentially runs  the mainstream media today. White House announcements are simply printed as “fact” with zero journalism and zero fact checking taking place.

9. Redefine dissent as treason. This is already happening with figures like Ted Nugent who was recently “visited” by the Secret Service after his anti-Obama rant. All throughout government speeches today, the criminals at the very top proclaim that anyone who questions government is “anti-American” and might be involved in domestic terrorism. The FBI even warns that people who “stockpile food” might be terrorists! (Even though the government itself stockpiles massive quantities of food, guns, ammunition, communications gear, medical supplies and more…)

10. Subvert the rule of law. Already done. Law has been completely abandoned by the ATF, DEA, FDA, USDA and every other federal agency you can think of. The Attorney General Eric Holder actively plots ways to destroy the Bill of Rights, and the government stages false flag terror attacks to undermine constitutional protections. Let us now define the term “presidential memorandum” so we will know what it is we’re talking about in the first place. This, from Wikipedia:

A presidential memorandum is a type of presidential order issued by the President of the United States to the executive branch of the United States government. Presidential memoranda do not have an established process for issuance or publication. Presidential memoranda are generally considered less prestigious than executive orders. In the past, presidential memoranda have been referred to as presidential letters.

There are three types of memorandum: “presidential determination” or “presidential finding”, “memorandum of disapproval”, and “hortatory memorandum”.

Presidential determination

Presidential dtermination, or presidential finding, are memoranda required by a statute and must be issued before certain actions are taken. For example, a presidential determination on the status of a country must be released before sanctions are imposed on the country.

A memorandum of disapproval is a public veto statement.

Hortatory memorandum

A hortatory memorandum is issued as a broad policy statement, but unlike a Presidential Proclamation is directed to executive agencies only.

Presidential Memorandum — Improving Availability of Relevant Executive Branch Records to the National Instant Criminal Background Check System

MEMORANDUM FOR THE HEADS OF EXECUTIVE DEPARTMENTS AND AGENCIES

SUBJECT: Improving Availability of Relevant Executive Branch Records to the National Instant Criminal Background Check System

Since it became operational in 1998, the National Instant Criminal Background Check System (NICS) has been an essential tool in the effort to ensure that individuals who are prohibited under Federal or State law from possessing firearms do not acquire them from Federal Firearms Licensees (FFLs). The ability of the NICS to determine quickly and effectively whether an individual is prohibited from possessing or receiving a firearm depends on the completeness and accuracy of the information made available to it by Federal, State, and tribal authorities.

The NICS Improvement Amendments Act of 2007 (NIAA) (Public Law 110-180) was a bipartisan effort to strengthen the NICS by increasing the quantity and quality of relevant records from Federal, State, and tribal authorities accessible by the system. Among its requirements, the NIAA mandated that executive departments and agencies (agencies) provide relevant information, including criminal history records, certain adjudications related to the mental health of a person, and other information, to databases accessible by the NICS. Much progress has been made to identify information generated by agencies that is relevant to determining whether a person is prohibited from receiving or possessing firearms, but more must be done. Greater participation by agencies in identifying records they possess that are relevant to determining whether an individual is prohibited from possessing a firearm and a regularized process for submitting those records to the NICS will strengthen the accuracy and efficiency of the NICS, increasing public safety by keeping guns out of the hands of persons who cannot lawfully possess them.

Therefore, by the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby direct the following:

Section 1. Improving the Availability of Records to the NICS. (a) Within 45 days of the date of this memorandum, and consistent with the process described in section 3 of this memorandum, the Department of Justice (DOJ) shall issue guidance to agencies regarding the identification and sharing of relevant Federal records and their submission to the NICS.

 (b) Within 60 days of issuance of guidance pursuant to subsection (a) of this section, agencies shall submit a report to DOJ advising whether they possess relevant records, as set forth in the guidance, and setting forth an implementation plan for making information in those records available to the NICS, consistent with applicable law.

(c) In accordance with the authority and responsibility provided to the Attorney General by the Brady Handgun Violence Prevention Act (Public Law 103-159), as amended, the Attorney General, consistent with the process described in section 3 of this memorandum, shall resolve any disputes concerning whether agency records are relevant and should be made available to the NICS.

(d) To the extent they possess relevant records, as set forth in the guidance issued pursuant to subsection (a) of this section, agencies shall prioritize making those records available to the NICS on a regular and ongoing basis.

Section 2. Measuring Progress. (a) By October 1, 2013, and annually thereafter, agencies that possess relevant records shall submit a report to the President through the Attorney General describing:

(i) the relevant records possessed by the agency that can be shared with the NICS consistent with applicable law;

(ii) the number of those records submitted to databases accessible by the NICS during each reporting period;

(iii) the efforts made to increase the percentage of relevant records possessed by the agency that are submitted to databases accessible by the NICS;

(iv) any obstacles to increasing the percentage of records that are submitted to databases accessible by the NICS;

(v) for agencies that make qualifying adjudications related to the mental health of a person, the measures put in place to provide notice and programs for relief from disabilities as required under the NIAA;

(vi) the measures put in place to correct, modify, or remove records accessible by the NICS when the basis under which the record was made available no longer applies; and

(vii) additional steps that will be taken within 1 year of the report to improve the processes by which records are identified, made accessible, and corrected, modified, or removed.

(b) If an agency certifies in its annual report that it has made available to the NICS its relevant records that can be shared consistent with applicable law, and describes its plan to make new records available to the NICS and to update, modify, or remove existing records electronically no less often than quarterly as required by the NIAA, such agency will not be required to submit further annual reports. Instead, the agency will be required to submit an annual certification to DOJ, attesting that the agency continues to submit relevant records and has corrected, modified, or removed appropriate records.

Section 3. NICS Consultation and Coordination Working Group. To ensure adequate agency input in the guidance required by section 1(a) of this memorandum, subsequent decisions about whether an agency possesses relevant records, and determinations concerning whether relevant records should be provided to the NICS, there is established a NICS Consultation and Coordination Working Group (Working Group), to be chaired by the Attorney General or his designee.

(a) Membership. In addition to the Chair, the Working Group shall consist of representatives of the following agencies:

(i) the Department of Defense;

(ii) the Department of Health and Human Services;

(iii) the Department of Transportation;

(iv) the Department of Veterans Affairs;

(v) the Department of Homeland Security;

(vi) the Social Security Administration;

(vii) the Office of Personnel Management;

(viii) the Office of Management and Budget; and

(ix) such other agencies or offices as the Chair may designate.

(b) Functions. The Working Group shall convene regularly and as needed to allow for consultation and coordination between DOJ and agencies affected by the Attorney General’s implementation of the NIAA, including with respect to the guidance required by section 1(a) of this memorandum, subsequent decisions about whether an agency possesses relevant records, and determinations concerning whether relevant records should be provided to the NICS. The Working Group may also consider, as appropriate:

(i) developing means and methods for identifying agency records deemed relevant by DOJ’s guidance;

(ii) addressing obstacles faced by agencies in making their relevant records available to the NICS;

(iii) implementing notice and relief from disabilities programs; and

(iv) ensuring means to correct, modify, or remove records when the basis under which the record was made available no longer applies.

(c) Reporting. The Working Group will review the annual reports required by section 2(a) of this memorandum, and member agencies may append to the reports any material they deem appropriate, including an identification of any agency best practices that may be of assistance to States in supplying records to the NICS.

Section 4. General Provisions. (a) Nothing in this memorandum shall be construed to impair or otherwise affect:

(i) the authority granted by law to a department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This memorandum shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c) This memorandum is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

(d) Independent agencies are strongly encouraged to comply with the requirements of this memorandum.

In addition to being a law enforcement challenge, gun violence is also a serious public health issue that affects thousands of individuals, families, and communities across the Nation. Each year in the United States there are approximately 30,000 firearm-related deaths, and approximately 11,000 of those deaths result from homicides. Addressing this critical issue requires a comprehensive, multifaceted approach.

Recent research suggests that, in developing such an approach, a broader public health perspective is imperative. Significant strides can be made by assessing the causes of gun violence and the successful efforts in place for preventing the misuse of firearms. Taking these steps will improve our understanding of the gun violence epidemic and will aid in the continued development of gun violence prevention strategies.

Therefore, by the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby direct the following:

Section 1. Research. The Secretary of Health and Human Services (Secretary), through the Director of the Centers for Disease Control and Prevention and other scientific agencies within the Department of Health and Human Services, shall conduct or sponsor research into the causes of gun violence and the ways to prevent it. The Secretary shall begin by identifying the most pressing research questions with the greatest potential public health impact, and by assessing existing public health interventions being implemented across the Nation to prevent gun violence.

Sectiom 2, General Provisions. (a) Nothing in this memorandum shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department or agency, or the head thereof; or

SUBJECT: Tracing of Firearms in Connection with Criminal Investigations

Reducing violent crime, and gun-related crime in particular, is a top priority of my Administration. A key component of this effort is ensuring that law enforcement agencies at all levels — Federal, State, and local — utilize those tools that have proven most effective. One such tool is firearms tracing, which significantly assists law enforcement in reconstructing the transfer and movement of seized or recovered firearms. Responsibility for conducting firearms tracing rests with the Department of Justice’s Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). Over the years, firearms tracing has significantly assisted law enforcement in solving violent crimes and generating thousands of leads that may otherwise not have been available.

Firearms tracing provides two principal benefits. First, tracing is an important investigative tool in individual cases, providing law enforcement agents with critical information that may lead to the apprehension of suspects, the recovery of other guns used in the commission of crimes, and the identification of potential witnesses, among other things. Second, analysis of tracing data in the aggregate provides valuable intelligence about local, regional, and national patterns relating to the movement and sources of guns used in the commission of crimes, which is useful for the effective deployment of law enforcement resources and development of enforcement strategies. Firearms tracing is a particularly valuable tool in detecting and investigating firearms trafficking, and has been deployed to help combat the pernicious problem of firearms trafficking across the Southwest border.

The effectiveness of firearms tracing as a law enforcement intelligence tool depends on the quantity and quality of information and trace requests submitted to ATF. In fiscal year 2012, ATF processed approximately 345,000 crime-gun trace requests for thousands of domestic and international law enforcement agencies. The Federal Government can encourage State and local law enforcement agencies to take advantage of the benefits of tracing all recovered firearms, but Federal law enforcement agencies should have an obligation to do so. If Federal law enforcement agencies do not conscientiously trace every firearm taken into custody, they may not only be depriving themselves of critical information in specific cases, but may also be depriving all Federal, State, and local agencies of the value of complete information for aggregate analyses.

Maximizing the effectiveness of firearms tracing, and the corresponding impact on combating violent crimes involving firearms, requires that Federal law enforcement agencies trace all recovered firearms taken into Federal custody in a timely and efficient manner.

Therefore, by the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby direct the following:

Section 1. Firearms Tracing. (a) Federal law enforcement agencies shall ensure that all firearms recovered after the date of this memorandum in the course of criminal investigations and taken into Federal custody are traced through ATF at the earliest time practicable. Federal law enforcement agencies, as well as other executive departments and agencies, are encouraged, to the extent practicable, to take steps to ensure that firearms recovered prior to the date of this memorandum in the course of criminal investigations and taken into Federal custody are traced through ATF.

(b) Within 30 days of the date of this memorandum, ATF will issue guidance to Federal law enforcement agencies on submitting firearms trace requests.

(c) Within 60 days of the date of this memorandum, Federal law enforcement agencies shall ensure that their operational protocols reflect the requirement to trace recovered firearms through ATF.

(d) Within 90 days of the date of this memorandum, each Federal law enforcement agency shall submit a report to the Attorney General affirming that its operational protocols reflect the requirements set forth in this memorandum.

(e) For purposes of this memorandum, “Federal law enforcement agencies” means the Departments of State, the Treasury, Defense, Justice, the Interior, Agriculture, Energy, Veterans Affairs, and Homeland Security, and such other agencies and offices that regularly recover firearms in the course of their criminal investigations as the President may designate.

Section 2. General Provisions. (a) Nothing in this memorandum shall be construed to impair or otherwise affect the authority granted by law to a department or agency, or the head thereof.

President Barack Obama launched the biggest U.S. gun-control push in generations on Wednesday, urging Congress to approve an assault weapons ban and background checks for all gun buyers to prevent mass shootings like the Newtown school massacre.

Rolling out a wide-ranging plan for executive and legislative action to curb gun violence, Obama set up a fierce clash with the powerful U.S. gun lobby and its supporters in Congress, who will resist what they see as an encroachment on constitutionally protected gun rights.

Obama presented his agenda at a White House event in front of an audience that included relatives of some of the 20 first graders who were killed along with six adults by a gunman on December 14 at Sandy Hook Elementary School in Newtown, Connecticut.

“We can’t put this off any longer,” Obama said, vowing to use “whatever weight this office holds” to make his proposals reality. “Congress must act soon,” he said, flanked by schoolchildren.

In a sign of how bitter the fight over gun control could get, the National Rifle Association released an advertisement hours before Obama spoke that accused him of hypocrisy for accepting armed Secret Service protection for his daughters. The White House condemned the ad as “repugnant.

Until now, Obama had done little to change America’s gun culture. But just days before his second inauguration, he appears determined to champion gun control in his next term, which also will be dominated by debt and spending fights with Congress and a likely debate over immigration reform.

His plan calls on Congress to renew a prohibition on assault weapons sales that expired in 2004, require criminal background checks on all gun purchases, including closing a loophole for gun show sales, and pass a new federal gun trafficking law – long sought by big-city mayors to keep out-of-state guns off their streets.

He also announced 23 steps he intends to take immediately without congressional approval. These include improving the existing system for background checks, lifting the ban on federal research on gun violence, putting more counselors and “resource officers” in schools and better access to mental health services.

The most contentious piece of the package is Obama’s call for a renewed ban on military-style assault weapons, a move that is unlikely to win approval because Republicans who control the House of Representatives are expected to oppose it.

The Newtown gunman, 20-year-old Adam Lanza, used a Bushmaster AR-15 type assault rifle to shoot his victims, most of them 6- and 7-year-olds, before killing himself.

Law enforcement experts have noted, however, that the tighter background checks that Obama is proposing would not have prevented the Connecticut school massacre because the gunman’s weapon was purchased legally by his mother.

New York Mayor Michael Bloomberg, a staunch gun control advocate, said tighter controls were needed no matter what.

“No piece of legislation is perfect and no piece of legislation is 100 percent effective. Think of it like a speeding limit. You may every once in a while violate the speeding limit, but that doesn’t mean we shouldn’t have speeding limits – they protect people’s lives,” he told reporters.

At the firearm industry’s largest trade show in Las Vegas, Gary Svecko – adding a Glock 17 pistol to his gun collection – dismissed Obama’s bid to ban assault weapons purchases and blamed video games for inciting violence.

“You know the old saying, ‘Guns don’t kill people. People kill people’,” Svecko, 58, said, citing a common argument of gun enthusiasts. “I think they should ban those stupid video games.”

Shares of gun manufacturers, including Smith & Wesson and Sturm Ruger, rose more than 5 percent after Obama unveiled his proposals. Since Newtown, FBI background checks required for gun purchases have soared, indicating more people are trying to buy weapons, likely out of concern that new restrictions may be imposed.

Controversial NRA Ad Campaign

Underscoring the tough political battle ahead, the NRA launched an advertising campaign against Obama’s gun control effort and deployed its lobbyists in force on Capitol Hill.

The NRA, in a TV and Internet spot, accused Obama of being “just another elitist hypocrite” for accepting Secret Service protection for his young daughters but turning down the lobby group’s proposal to put armed guards in all schools.

“Only honest, law-abiding gun owners will be affected and our children will remain vulnerable to the inevitability of more tragedy,” the group said in response to Obama’s proposals.

Administration officials sketched out legislative goals in a conference call with reporters but offered no draft legislation or any clear explanation of how they would overcome the hurdles. They said the list of executive actions would cost $500 million in the federal budget for the 2014 fiscal year.

With gun ownership rights enshrined in the Second Amendment of the U.S. Constitution, gun restrictions have long been a divisive – and risky – issue in American politics.

But polls show public sentiment shifted in favor of tighter gun control fueled by outrage after Newtown, and Obama hopes to take advantage while there is a mood for action in Washington. The pattern after shooting tragedies is that memories of the events soon fade, making it hard to sustain a push for policy changes.

Obama acknowledged the political challenges but made clear he is prepared to take on the NRA, despite its support among Republicans and significant backing among Democrats.

He warned that opponents of his effort would try to “gin up fear” and urged lawmakers to put children’s safety above getting an ‘A’ grade from the gun lobby that supports their campaign.”

Senate Majority Leader Harry Reid, a pro-gun-rights Democrat from Nevada, also responded cautiously, saying “all options should be on the table” to reduce gun violence.

Obama’s initiative treads carefully on whether violent movies and video games contribute to gun violence. An administration official said, however, that Obama would seek $10 million to fund studies of the causes of gun violence, including any relationship to video games and media images.

(Washington) The Obama administration is talking with both gun-safety and gun-rights groups this week to help end gun violence in the wake of the shootings in Newtown, Connecticut.

President Barack Obama is “determined to take action” against gun violence and is weighing possible executive orders aimed preventing further attacks like last month’s shooting massacre at a Connecticut elementary school, Vice President Joe Biden said on Wednesday.

Biden spoke to reporters at the start of a White House meeting with gun violence victims and gun-control advocates as part of his effort to craft a package of recommendations that Obama has requested by the end of January.

“I want to make it clear that we are not going to get caught up in the notion (that) unless we can do everything we’re going to do nothing,”  Biden said. “It’s critically important (that) we act.”

Biden heard personal stories of gun violence from representatives of victims groups and gun-safety organizations as he drafts the Obama administration’s response to the shooting at a Connecticut elementary school. He pledged that action would be taken.

The meeting was part of a series Biden is holding this week to build consensus around proposals to curb gun violence after the Dec. 14 shooting in Newtown, Conn. Twenty school children were killed.

Biden meets Thursday with the National Rifle Association and other gun-owner groups. Meetings with representatives of the video-game and entertainment industries also are planned.

President Barack Obama wants Biden to deliver policy proposals by the end of the month. Obama has vowed to move swiftly on the package, which is expected to include legislative proposals and executive action.

Participants in Wednesday’s meeting with Biden included the Brady Campaign to End Gun Violence and groups from Arizona, Illinois and Wisconsin, states with spates of gun violence that garnered national attention, including the shooting in Arizona of then-Rep. Gabrielle Giffords. Also present were two survivors of the 2007 shooting at Virginia Tech that killed 32 people, as well as a stepfather of a victim of last July’s massacre at a movie theater in Aurora, Colo., in which a dozen people were slain. Attorney General Eric Holder also attended.

But as the shock and sorrow over the Newtown, Conn., shooting fades, the tough fight facing the White House and gun-control backers is growing clearer. Gun-rights advocates, including the powerful NRA, are digging in against tighter gun restrictions, conservative groups are launching pro-gun initiatives and the Senate’s top Republican has warned it could be spring before Congress begins considering any gun legislation.

“The biggest problem we have at the moment is spending and debt,”  Senate Minority Leader Mitch McConnell of Kentucky said this week. “That’s going to dominate the Congress between now and the end of March. None of these issues will have the kind of priority as spending and debt over the next two or three months.”

The killing of 6- and 7-year-olds at Newtown’s Sandy Hook Elementary School appeared to stir a deep reaction from the White House and Capitol Hill. Obama pushed gun control to the top of his domestic agenda for the first time and pledged to put the full weight of his presidency behind the issue. Some Republican and conservative lawmakers with strong gun-rights records also took the extraordinary step of calling for a discussion on new measures.

But other gun-rights advocates have shown less flexibility. The NRA has rejected stricter gun legislation and suggested instead that the government put armed guards in every U.S. school as a way to curb violence. A coalition of conservative groups is also organizing a “Gun Appreciation Day” to coincide with Obama’s inauguration this month.

The president hopes to announce his administration’s next steps to tackle gun violence shortly after he is sworn in for a second term on Jan. 21.

Obama wants Congress to reinstate a ban on military-style assault weapons, close loopholes that allow gun buyers to skirt background checks and restrict high-capacity magazines. Other recommendations to the Biden group include making gun-trafficking a felony, getting the Justice Department to prosecute people caught lying on gun background-check forms and ordering federal agencies to send data to the National Gun Background Check Database.

Some of those steps could be taken through executive action, without the approval of Congress. White House officials say Obama will not finalize any actions until receiving Biden’s recommendations.

Gun-rights lawmakers and outside groups have insisted that any policy response also include an examination of mental health policies and the impact of violent movies and video games. To those people, the White House has pledged a comprehensive response.

“It is not a problem that can be solved by any specific action or single action that the government might take,” said White House spokesman Jay Carney said. “It’s a problem that encompasses issues of mental health, of education, as well as access to guns.”

In addition to Biden’s meetings this week, Education Secretary Arne Duncan will meet with parent and teacher groups, and Health and Human Services Secretary Kathleen Sebelius will meet with mental health and disability advocates.

The White House said other meetings are also scheduled with community organizations, business owners and religious leaders. (Sources: MSN)

From inadecuate vetting to Black Panther intimidation at the polls, the 2008 election still stinks

Felony charges related to election fraud have touched the 2008 race for the highest office in the land.

Prosecutors in South Bend, Indiana, filed charges Monday against four St. Joseph County Democratic officials and deputies as part of a multiple-felony case involving the alleged forging of Democratic presidential primary petitions in the 2008 election, which put then-candidates Barack Obama and Hillary Clinton on the Indiana ballot.

The officials are accused of taking part in a scheme to fake signatures and names on the primary petitions needed to run for president. Court papers say the plan was hatched by local Democratic Party officials inside the local party headquarters.

Among those charged is the former long-time chairman of the St. Joseph County Democratic Party, Butch Morgan, who allegedly ordered the forgeries. He was forced to resign when the allegations were first made public last October, even though his lawyer, Shaw Friedman, told Fox News at the time that Morgan did not do anything wrong.

The St. Joseph County Board of Voter Registration’s Democratic board member, Pam Brunette, Board of Voter Registration worker Beverly Shelton and Democratic volunteer and former board worker Dustin Blythe also face charges.

According to affidavits, St. Joseph County Voter Registration Office worker Lucas Burkett told investigators that he was part of the plan that started in January 2008 “to forge signatures on presidential candidate petitions instead of collecting actual signatures from citizens.”

The documents state that Burkett told investigators that “he was heavily involved in St. Joseph County political activities with the local Democratic party,” and that “he had, in fact, personally forged several such signatures,” and had attended meetings at the local

Democratic party headquarters, where it was agreed to forge the petitions. Morgan, the County Democratic Chairman, allegedly “instructed Mr. Burkett, Pamela Brunette, Beverly Shelton, and Dustin Blythe to forge ballot petitions for presidential candidates,” and that “all of them agreed to follow these instructions” by copying names and signatures from old election petitions.

According to affidavits, Burkett told investigators it was his job to “forge petitions for candidate Barack Obama,” Shelton “was assigned to forge petitions for candidate Hillary Clinton,” and Blythe “was assigned to forge petitions for candidate John Edwards.” When Edwards dropped out of the race at the end of January 2008 and Burkett refused to continue the forgeries, Morgan allegedly ordered Blythe to then forge petitions for Barack Obama.

Indiana State Police investigators identified a total of 22 petitions that appeared to be faked, yet sailed through the Voter Registration Board as legitimate documents. The signature of the board’s Republican supervisor, Linda Silcott, which is required for legal certification, appeared to be rubber stamped on the documents. She told investigators that she did not remember signing or authorizing her rubber stamp to be used.

Silcott also told investigators that she recognized the handwriting on the alleged forged Obama petitions as that of Blythe’s.

The South Bend Tribune  and independent political newsletter Howey Politics Indiana  have reported that a handwriting analyst concluded last fall that Blythe’s handwriting matched some of the alleged Obama fakes.

The case raises the possibility that the president’s campaign and that of Clinton’s, could have been legally challenged in Indiana if the alleged forgeries were discovered during the race.

Under state law, presidential candidates need to qualify with 500 signatures from each of Indiana’s nine congressional districts. Indiana elections officials say that in St. Joseph County, which is the 2nd Congressional District, the Obama campaign qualified with 534 signatures; Clinton’s camp had 704.

But the signatures, which were certified by the elections board, were never challenged. If the number of legitimate signatures for Obama or Clinton fell below the legal requirement of 500, they could have been bounced from the state ballot. Reports have previously put the number of phony signatures for both candidates at about 150, but state investigators plucked names from the petitions at random and cited only 20 individual alleged forgeries as part of their case. They say their investigation of the petitions continues.

President Obama, during a joint press conference Monday with the leaders of Canada and Mexico, employed his strongest language to date on the Supreme Court review of the federal health care overhaul, saying he’s “confident” the law will be upheld, but cautioning the “unelected” court against reaching any other conclusion.

“I’m confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress,”  Obama said. “And I’d just remind conservative commentators that for years what we’ve heard is the biggest problem on the bench was judicial activism or a lack of judicial restraint, that an unelected group of people would somehow overturn a duly constituted and passed law. Well, this is a good example. And I’m pretty confident that this court will recognize that and not take that step.”

The Supreme Court spent three days hearing arguments last week in four separate challenges to the health care law, which stands as the president’s signature domestic policy accomplishment. A central challenge was over the individual mandate — the requirement that Americans buy health insurance. Critics say the mandate is unconstitutional, and that the federal government cannot force people into the insurance marketplace.

Obama on Monday said that without such a mandate, the law would not have a mechanism to ensure those with preexisting conditions get health care.

“I’m confident that this will be upheld because it should be upheld,”  Obama said, describing the law as “constitutional.”

Republican lawmakers slammed the president for his Supreme Court comments, accusing President Obama of trying to “intimidate” the Supreme Court by wrongly suggesting a ruling against the health care overhaul would be “judicial activism.”

Senator Orrin Hatch, R-Utah, top Republican on the Senate Finance Committee, accused the president of misrepresenting the implications of a ruling against the law.

“It must be nice living in a fantasy world where every law you like is constitutional and every Supreme Court decision you don’t is ‘activist,’”  he said in a statement. “Judicial activism or restraint is not measured by which side wins but by whether the Court correctly applied the law.”

“Many of us have been arguing for nearly three years that the federal government does not have the power to dictate individuals’ purchasing decisions,”  Hatch added, “After a national debate on the subject, more than two-thirds of Americans agree that the Obamacare insurance mandate is unconstitutional.”

The president spoke following meetings with Mexican President Felipe Calderon and Canadian Prime Minister Stephen Harper. Until the heath care case remarks, the press conference was focused mostly on economic issues, as well as the war on drugs.

The leaders vowed a new effort to boost North American trade and cut needless regulation that stifles it. “Our three nations are going to sit down together, go through the books and simplify and eliminate more regulations that will make our joint economies stronger,”  Obama said.

Obama noted trade among the three neighbors now tops $1 trillion a year, and he wants to see that number rise.

The president’s challenge to the high court drew widespread attention, on the eve of the Republican presidential candidates’ next round of primaries — Wisconsin, Maryland and the District of Columbia are voting Tuesday. All the candidates oppose the health care law, though front-runner Mitt Romney has come under fire for his role in passing one with similar provisions while governor of Massachusetts.

Romney, who describes the federal law as an overreach, also slammed Obama for his Supreme Court comments on Tuesday.

Romney, in an interview on Fox News, said an activist court is one that “departs” from the Constitution and legislates from the bench. In this case, he said, the judges simply are weighing whether a law is constitutional.

“That will not be an activist court — that will be a court following the Constitution,”  Romney said.

Rep. Lamar Smith, R-Texas, chairman of the House Judiciary Committee, agreed.

“Nothing could be more appropriate for the Supreme Court to decide than whether a bill is constitutional or not,”  he told Fox News Radio, adding that he was “disappointed” by the president’s remarks.

“It is not unprecedented at all for the Supreme Court to declare a law unconstitutional; they do that on a regular basis so it’s not unprecedented at all,”  he said. “What is unprecedented is for the president of the United States trying to intimidate the Supreme Court.”
